- ANALYSIS - This resolution approves a second amendment to the Metro Center development Out-of-Program Agreement. The agreement currently requires that the City design and contract for (or construct with City forces) all the improvements. Several of the planned improvements will be funded 100% by the developer. The proposed amendment would allow the developer to contract for certain improvements where funding for same is coming 100% from the developer. The City would still design these improvements and undertake on-site inspection of the work.


BODY:
Whereas, On July 11th, 1997, the Common Council of the City of Milwaukee adopted file number 970478 being a resolution approving an Out-of-Program Agreement for Phase I of the Metro Center development to be located generally south of West Good Hope Road and east of US Highway 41; and

Whereas, On September 23rd, 1997, Common Council adopted file number 970789 being a resolution approving the first amendment to the Out-of-Program Agreement; and

Whereas, Under the terms of the approved Out-of-Program Agreement the developers are obligated to fund 100% of certain public improvements; and

Whereas, It might be in the interest of both the developers and the City of Milwaukee for the developers to contract for some or all of the improvements which the developers are solely responsible for funding; and
