Analysis
This resolution authorizes a partial settlement of the lawsuit of Gregory Thornton, et al. v. City of Milwaukee, et al., in the amount of $42,603.43.
Body
Whereas, The plaintiff, Gregory Thornton, has filed a lawsuit against the City of Milwaukee and Lamont Hodnett seeking an unspecified sum of damages; and

Whereas, In the trial of this case, the trial court found that one of the defendants, former Milwaukee police officer Lamont Hodnett, was acting within the scope of his employment at the time of the shooting that is the subject of this lawsuit; and

Whereas, Mr. Hodnett was represented by separate, private counsel due to the conflict of interest of the City Attorney with respect to the issue of Mr. Hodnett's scope of employment; and

Whereas, Counsel for Mr. Hodnett has agreed to a partial settlement of this lawsuit with respect to his claim for attorneys fees and expenses for the defense of Mr. Hodnett in the trial of this matter in the amount of $42,603.43; and

Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to pay this portion of the lawsuit at this time; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the proper City officers be and hereby are authorized and directed to issue a City check in the amount of $42,603.43 payable to the order of the Eggert & Cermele, S.C., in full and final settlement of their claim for attorneys fees for representing Lamont Hodnett in the above-referenced trial, upon receipt of a release of claims, approved as to form and execution by the City Attorney, said amount to be charged to the Damages and Claims Fund, Account No. 636506 0001 1490 2631 S118-2003.
