- Analysis -
 
This resolution waives the requirement to construct concrete sidewalks in West Metro Boulevard and directs the City Engineer to modify the paving plans by removing the sidewalk.
 
 
BODY:
Whereas, Section 113-12.5 of the Milwaukee Code of Ordinances indicates that sidewalks shall be installed when a permanent urban roadway is constructed; and
 
Whereas, The Common Council can waive this requirement; and
 
Whereas, The paving plans for West Metro Boulevard between North 107th Street and the USH 41/45 off-ramp include sidewalk, and were previously approved by adoption of Common Council Resolution Number 971447 on January 20, 1998; and
 
Whereas, The developer for the Metro Center Development has requested that the sidewalks be eliminated from both sides of West Metro Boulevard; and
 
Resolved, By the Common Council of the City of Milwaukee that the requirement for concrete sidewalk be installed as part of the improvement of West Metro Boulevard between North 107th Street and the USH 41/45 off-ramp is hereby waived, and, be it
 
Further Resolved, That the City Engineer is directed to modify the paving plans and take action as necessary to delete the sidewalk installation as part of the improvement project.
