This substitute resolution approves a revision to the Public Access Easement and Maintenance Agreement between Boulder Venture 9, LLC, the developer undertaking the Capitol Court redevelopment project, and the City of Milwaukee.
Body
Whereas, The subject Public Access Easement and Maintenance Agreement was approved by Common Council of the City of Milwaukee on August 2, 2001 under File No. 010408 and recorded at the Milwaukee County Register of Deeds on October 24, 2001 and assigned Document No. 8156517; and
Whereas, Said approved Public Access Easement and Maintenance Agreement allows the Grantor, the City of Milwaukee, to cancel the easement located on the access drive at North 58th Street and West Capitol Parkway upon the mutual concurrence of the Grantee, Boulder Venture 9, LLC or upon formal vacation of the entire West Capitol Parkway; and
Whereas, The Common Council approved the vacation of the remainder of West Capitol Parkway on November 6, 2001 under File No. 010620; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that Exhibit B of said Public Access Easement and Maintenance Agreement is revised to remove the depicted easement located across the access drive at North 58th Street and West Capitol Parkway; and, be it
Further Resolved, That the Commissioner of Public Works is authorized to make minor, non-substantive changes in the agreement prior to its execution.
