Analysis
This resolution authorizes the Commissioner of Public Works to execute a Maintenance Agreement with the Wisconsin Department of Transportation for the Lake Parkway, which provides for ownership, operation, and maintenance of the facility and any local infrastructure components affected by its construction. This agreement will act as a reference to all those who, in the future, may need direction with respect to where responsibility lies for the numerous facilities constructed as part of and/or affected by this project.
Body
Whereas, The Wisconsin Department of Transportation (WISDOT) recently completed construction of the Lake Parkway (STH 794); and

Whereas, Portions of the Lake Parkway are located within the City of Milwaukee; and

Whereas, Several City of Milwaukee infrastructure components were affected by the construction of the Lake Parkway; and

Whereas, The City of Milwaukee and WISDOT staffs have worked together to prepare an Agreement to formalize the ownership, operation, and maintenance of the Lake Parkway facility and those local infrastructure components affected by its construction; and

Whereas, The Agreement places the primary maintenance responsibility for the Lake Parkway on the WISDOT, however, the City will retain ownership and maintenance responsibility for adjacent streets, sidewalks, etc.; and

Whereas, No significant fiscal impact is anticipated with the Agreement; and

Whereas, A draft copy of the Agreement is attached to Common Council File No. 011622, and incorporated in this resolution by reference as though set forth in full; now, be it
