Analysis
This resolution releases a no vehicular access restriction along a portion of West McKinley Avenue (south side) between North Dr. Martin Luther King Jr. Drive and North Vel R. Phillips Avenue, in the 6th Aldermanic District.
Body
Whereas, the final plat of the Park East, recorded on May 18, 2007, placed a No Vehicular Access Restriction along a portion of the south side of West McKinley Avenue between North Dr. Martin Luther King Jr. Drive and North Vel R. Phillips Avenue; and
Whereas, the no access restriction does not allow driveway access on West McKinley Avenue; and
Whereas, a prospective developer is requesting the removal of this No Vehicular Access Restriction to allow development and improvement of the land; and
Whereas, upon reviewing the No Vehicular Access Restriction, the City Engineer has no objection to releasing of said access restriction; and
Whereas, John Leo Brey, a Wisconsin Registered Land Surveyor, submitted an affidavit of access restriction release pursuant to the provisions of Section 236.295, Wisconsin Statutes now, therefore, be it
Resolved, by the Common Council of the City of Milwaukee, that the restriction for No Vehicular Access from the west line and north line of Lot 1, Block 4, Park East on the West Side of the Milwaukee River, and the east line and north line of Lot 2, Block 4, Park East on the West Side of the Milwaukee River, in the Southeast 1/4 of Section 20, Township 7 North, Range 22 East, be released; and, be it
