Analysis
This resolution authorizes settlement of the claim of MPSO for interest and penalties as a result of delinquent payment of retroactive pay in conjunction with the 1995-96 labor contact between the City and MPSO.
BODY:
WHEREAS, The labor agreement between the City and MPSO was executed on February 22, 1996; and
WHEREAS, Under s. 109.03, Stats., retroactive payments were to be made within 31 days thereafter; and
WHEREAS, For the 1995-96 labor agreement between the City and the MPSO the City was to pay retroactive wage payments in the amount of $1,270,738, and such payments were made on April 18, 1996; and
WHEREAS, Under a similar situation involving the 1993-94 agreement between the City and MPSO, the Circuit Court in Case No. 96-CV-007749 awarded the MPSO civil penalties as authorized under s. 109.11(2), Stats., to include interest, attorney fees and costs; and
WHEREAS, MPSO has offered to settle its claim with respect to the 1995-96 contract on the same basis as judgment was entered in the earlier action, and the City Attorney recommends such settlement; now, therefore be it
RESOLVED, By the Common Council of the City of Milwaukee, that the proper officers be and hereby are authorized to issue a City check in the amount of $5,176.04, payable to the Milwaukee Police Supervisors Organization and its attorney Robert B. Fennig, such check to be delivered upon receipt of a properly executed release in a form acceptable to the Office of the City Attorney, said amount to be charged to the Damages and Claims Fund Account No. 01-013-8001.
