This resolution authorizes cancellation of $25,536.45 of the City's subrogation claim against Pamela Grote in the amount of $27,036.45 for payments made pursuant to the City's Basic Health Plan.

BODY:
Whereas, On April 12, 1993, Pamela Grote was involved in an automobile collision at the intersection of East Capitol Drive and Barker Road; and
Whereas, As a result of injuries sustained in that accident, the City of Milwaukee has made payments on behalf of Pamela Grote for treatment of such injuries pursuant to its Basic Health Plan in the amount of $27,036.45; and
Whereas, The City of Milwaukee has a subrogation claim against Pamela Grote as a result of such payments; and
Whereas, The parties have agreed to settle this claim for $1,500.00, and the difference between the original claim and the settlement is $25,536.45; and
Whereas, This settlement reflects the legal liability of the parties and is a fair and equitable resolution of the City of Milwaukee's subrogation claim; now, therefore be it
Resolved, By the Common Council of the City of Milwaukee, that the subrogation claim of the City of Milwaukee against Pamela Grote arising out of payments for treatment of injuries sustained in an automobile collision on April 12, 1993 at East Capitol Drive and Barker Road is hereby cancelled in the amount of $25,536.45.
