This substitute resolution will vacate an unimproved pedestrian walkway in accordance with vacation proceedings under power granted to the City of Milwaukee by Section 66.297(1), Wisconsin Statutes, and Section 81-308-28 of the Milwaukee Code of Ordinances.
BODY:
Whereas, A petition was presented to the Public Improvements Committee of the Common Council of the City of Milwaukee by the Department of City Development of the City of Milwaukee on the 9th day of December, 1998, for the vacation of an unimproved pedestrian walkway at the properties located between 3776 North 98th Street and 3784 North 98th Street; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the benefit assessments of $1,755 otherwise required to be paid to the City Treasurer prior to receiving the petition for said vacation be waived, and the City Treasurer is authorized to waive said fee pursuant to Ordinance 234 of the City of Milwaukee; and, be it

Further Resolved, That said petition is granted and that the following described portion of said pedestrian walkway to-wit:

Description of the pedestrian walkway East of North 98th Street at West Vienna Avenue extended, which is proposed to be vacated, in the 5th Aldermanic District of the City of Milwaukee.

All of the 18 foot wide pedestrian walkway lying between and adjacent to Lots 8 and 9 in Block 5 of Ridgedale, a recorded subdivision, in the Northeast 1/4 of Section 8, Township 7 North, Range 21 East.
