Title

Substitute resolution authorizing and directing the proper City officers to execute sewer and water agreement SA-1918 and WA-291 allowing the construction of portions of buildings within a City of Milwaukee sewer and water easement.

Analysis

This substitute resolution authorizes and directs the proper City officers to execute a Permit and Agreement document.

Body

Whereas, On May 5, 1971, the City was granted an easement, SE-1918 and WE-291, for sewer and water purposes in vacated North 14^th Street between West Clybourn Street and West Wisconsin Avenue; and

Whereas, Said easements are located in lands presently owned by Marquette University (the Owner); and

Whereas, The Owner has requested the City's permission to construct portions of a building in and over a portion of the easements areas; and

Whereas, The City will allow the construction of said portions of the building in and over a portion of the easements areas, subject to conditions stipulated in Permit and Agreement document known as SA-1918 and WA-291; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officers are hereby authorized and directed to execute Permit and Agreement SA-1918 and WA-291, said Permit and Agreement being attached to Common Council File Number 010808 and incorporated in this resolution by reference as though set forth in full; and, be it

Further Resolved, That after said Permit and Agreement document has been executed by the proper City officers, it shall be forwarded to the office of the City Attorney for approval as to form and execution and then to the office of City Real Estate for recording and proper distribution.
