Title
An ordinance relating to consumption of alcohol beverages upon public parking structures and surface lots.

Analysis
Under current code provisions, it is unlawful for any person to consume any alcohol beverages or possess any alcohol bottle or receptacle if the bottle or receptacle has been opened, the seal has been broken, or the contents of the bottle or receptacle have been partially removed while upon any public parking structure or public parking surface lot within the limits of the city. This ordinance exempts Miller Park parking surface lots from this prohibition during sporting events and concerts and any temporary extension of a class "B" tavern licensed premises granted by the common council.

Body
Whereas, The Common Council finds it appropriate to prohibit the consumption of alcohol beverages in public parking structures and public parking lots as it constitutes a danger to the health, safety and welfare of the citizens of the city of Milwaukee; and

Whereas, Miller Park, and its predecessor, County Stadium, have a long tradition of the celebratory practice of eating and socializing before sporting events and concerts on parking surface lots; and

Whereas, This activity also known as tailgating, includes the consumption of alcohol beverages, has been well regulated by law enforcement officers; and

Whereas, Miller Park provides receptacles for waste produced by tailgating; and

Whereas, The Common Council has also deemed it appropriate to permit class "B" taverns to temporarily extend their premises onto parking lots pursuant to code provisions; now, therefore,

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. Section 106-2.1-1.5 of the code is repealed and recreated to read:

106-2.1. Drinking Upon Public Parking Structures and Public Parking Surface Lots.
