Analysis
This ordinance provides that a contractor who holds a valid HVAC qualifier certification or a valid dwelling contractor certification and a valid dwelling contractor qualifier certification issued by the state of Wisconsin need not obtain a home improvement contractor’s or salesperson’s license, but shall in all other respects comply with the city’s home improvement contractor licensing regulations (namely, required and prohibited practices). The HVAC qualifier certification and the dwelling contractor certification/dwelling contractor qualifier certification are the state of Wisconsin’s credentials for persons who install or service HVAC equipment and for home builders and other general construction contractors, respectively.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. Section 95-14-2-b-4 and 5 of the code is created to read:

95-14. Home Improvement Contractor and Salesperson Licenses.

2. LICENSE REQUIRED.

b. Exemptions.

b-4. A contractor who holds a valid dwelling contractor certification and a valid dwelling contractor qualifier certification issued by the state of Wisconsin need not obtain a home improvement contractor’s or salesperson’s license, but shall in all other respects comply with this section.

b-5. A contractor who holds a valid HVAC qualifier certification issued by the state of Wisconsin need not obtain a home improvement contractor’s or salesperson’s license, but shall in all other respects comply with this section.
