Analysis
This resolution will remove a deed restriction imposed by the City of Milwaukee that prohibits division of property and construction of any principal buildings on property sold by the City.
Body
Whereas, Pursuant to Common Council File No. 84-838, adopted October 23, 1984, the City of Milwaukee conveyed to Rosemary Holley by Quit Claim Deed dated November 15, 1984, part of a tax-deed vacant lot at 2429 North 4th Street that adjoined her property at 2435 North 4th Street; and
Whereas, The deed of conveyance contains restrictions that the land conveyed therein "shall be used as open space and no principal buildings may be erected thereon," to join the lot with the buyer's adjoining property so as to create a single parcel to be used as a unit and that the combined parcel shall not be divided without the approval of the Common Council of the City of Milwaukee; and
Whereas, Ms. Holley's home was razed due to fire damage and she wishes to rebuild; and
Whereas, Removal of the deed restriction is required for the property owner to build on the premises; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the proper City officials are authorized and directed to execute the necessary legal documents to remove the restrictions contained in the deed dated November 15, 1984 so as to allow for development of the property.
