- Analysis -

The city's noxious weed ordinance prohibits weeds exceeding 9 inches in height on any property in the city. This ordinance requires that the department of public works, whenever it finds a property to be in violation of this prohibition, serve written notice of the violation to the property owner. Such notice shall also specify that the violation is to be corrected within 3 days of service of the notice and that, if the weeds are not destroyed, the city will cause the weeds to be destroyed and recover the costs of such action by placing a special tax on the property.

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. Section 80-17-5 of the code is created to read:

80-17. Hay Fever Weeds, etc.

5. NOTICE TO PROPERTY OWNER. Whenever the department of public works determines that a property is in violation of sub. 1, the department shall serve written notice of the violation on the owner of the property. Such notice shall also state that the weeds shall be destroyed within 3 days of service of the notice and that, if the weeds are not destroyed, the city will cause the weeds to be cut or otherwise destroyed and recover the cost of such action by collecting a tax on the property pursuant to s. 66.98(1), Wis. Stats. A notice shall be deemed to be properly served upon the property owner if a copy is delivered to the owner personally, or, if the owner cannot be found, by leaving a copy at the owner's usual place of abode in the presence of a member of the owner's family of suitable age and discretion who shall be informed of the contents, by sending a copy by registered mail, with return receipt requested, to the owner's last known addre...
