Title

Substitute resolution relating to Residential Preference Program requirements for deconstruction contracts.

Analysis

This resolution directs the Department of Neighborhood Service to determine that the appropriate level of participation for unemployed or underemployed residents on City deconstruction contracts is 0%.

Body

Whereas, Section 309-41-2 of the Code of Ordinances provides that contracts funded by city, state or federal funds must contain a requirement that a portion of the worker hours associated with the contracts be performed by unemployed or underemployed residents of the city; and

 

Whereas, The City department issuing a contract is required to determine the appropriate level of participation of unemployed or underemployed residents of the City in the contract; and

 

Whereas, Section 309-41-3-a-2 of the Code presumes the appropriate level of resident participation to be 40% unless the department issuing the contract determines there is sufficient reason to impose a lesser requirement; and 

 

Whereas, Deconstruction crews tend to be small, making it difficult for contractors to meet the resident participation requirements; and

 

Whereas, The Department of Neighborhood Services has identified a lack of contractors who can meet the resident participation requirements as an impediment to implementing the City’s deconstruction ordinance (s. 218-10 of the Code); now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Department of Neighborhood Services is directed to determine, pursuant to the authority granted to it under s. 309-41-3-a-2 of the Code, that the appropriate level of participation of unemployed or underemployed residents on City deconstruction contracts is 0%.
