Body
Whereas, Peter J. Lentscher requested permission to construct and maintain a wood deck structure for seating in the public right-of-way; and

Whereas, Permission for said wood deck structure for seating was granted in 1999 under Common Council File Number 990377; and

Whereas, Todd and Nancy Sokolowski now own the property; and

Whereas, For the liability to be formally transferred to the current property owner, the Common Council needs to adopt an amending resolution; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that Common Council File Number 990377 is hereby rescinded; and, be it

Further Resolved, That Todd and Nancy Sokolowski, 6120 South 18th Street, Milwaukee, WI 53221, are hereby granted the following special privilege:

To keep and maintain a wood deck encroaching 10 inches into the east 15-foot wide, fully paved sidewalk area of South Howell Avenue. The deck commences at a point approximately 130 feet south of the southline of East Norwich Street and extends south 41 feet 4 inches. The deck structure consists of wood planks resting atop wood stringers and posts with a 6-foot tall iron fence enclosing the outside of the deck structure.

Said deck structure shall be used, kept and maintained to the satisfaction of the Commissioners of Public Works and Department of Neighborhood Services.
