Analysis
State statutes require that traffic laws be uniform and uniformly enforced statewide and that municipal regulation conform with state rules of the road and other traffic statutes. State traffic laws define the term “vehicle” to include a bicycle and regulate the operation of bicycles on all highways and public ways.

This ordinance revises current bicycle registration and licensing requirements making registration and licensing permissive rather than mandatory.

This ordinance revises current bicycle city regulations related to the operation of bicycles that do not conform with state law. These include the definition of a bicycle, the operation of bicycles 2 or more abreast, and the definition of “local authorities” for purposes of designating bicycle ways. The penalties provided for violation of bicycle operation regulations and equipment requirements have also been revised to conform to state forfeiture limits.

City ordinances currently address the disposition of abandoned motor vehicles, but do not directly address the disposition of lost, stolen, abandoned or unclaimed bicycles. This ordinance provides procedures for identification of lost, stolen and abandoned bicycles, and for impounding, redeeming and disposing of bicycles. A special fund is created for deposit of proceeds received as a result of disposal of bicycles from which expenditures may be made for purchase of bicycles and bicycle equipment for police patrols and for the maintenance and repair of bicycles.

The ordinance includes provisions addressing the disposition of impounded bicycles and provides that revenues from sale or other disposition of impounded bicycles be placed in a new police bicycle and bicycle equipment special purpose fund. The chief of police is author...
