This resolution authorizes proper City officials to execute Sewer Easement Agreement SE-2862 in vacated North 38th Street located between West Highland Boulevard and vacated West Linden Street, in the 15th Aldermanic District.

Body
Whereas, The City of Milwaukee requested an easement needed for sewer facilities in vacated North 38th Street between West Highland Boulevard and vacated West Linden Street; and

Whereas, The easement area is in lands owned by MillerCoors, LLC; and

Whereas, The land-owner is willing to grant Sewer Easement Agreement SE-2862 to the City giving the City permission to enter the property to construct, operate, maintain, inspect, and repair, as City deems necessary, sewer facilities within the easement area on terms and conditions negotiated by the City’s Department of Public Works, as reflected in the easement document that has been made part of this file; and

Whereas, MillerCoors, LLC has also requested the City’s permission to construct a guard shack and associated landscape and parking areas (Improvements) within a portion of the easement; and

Whereas, Based on the terms contained in Sewer Easement Agreement SE-2862, the City is willing to grant MillerCoors, LLC permission to construct and maintain said Improvements; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officials, including the DPW Commissioner, are hereby authorized: (i) to allow the MillerCoors, LLC to construct and maintain said Improvements within the Easement Area subject to the terms contained in Sewer Easement Agreement SE-2862, and (ii) to sign the Sewer Easement Agreement, in the form and substance submitted to thi...
