Resolution removing a deed restriction from two former tax-deed, vacant lots formerly known as 219 East Wright Street and 2469 North Hubbard Street, in the 6th Aldermanic District. (DCD-Real Estate)
Analysis
This resolution will remove a deed restriction imposed by the City of Milwaukee that prohibits division of land and construction of a principal building.
Body
Whereas, Pursuant to File No. 79-1453 adopted May 8, 1980 and File No. 85-33 adopted May 31, 1985, the City of Milwaukee conveyed to Theola Simmons by Quit Claim Deeds dated July 22, 1980 and June 24, 1985, respectively, two tax-deed, vacant lots at 219 East Wright Street and 2469 North Hubbard Street that adjoined her property at 213 East Wright Street; and

Whereas, The deeds of conveyance contained restrictions that “the property herein conveyed shall be joined with the grantee's adjoining property so as to create a single parcel to be used as a unit; that said combined parcel shall not be divided without the approval of the Common Council of the City of Milwaukee; and that the land herein conveyed shall be used as open space and no principal building may be erected thereon”; and

Whereas, The combined property was acquired in 1999 by Beatrice Simons Baker and Willie J. Baker who now desire to build an owner-occupied, single-family home on the vacant portion of their property, but need the deed restriction released to obtain a building permit; and

Whereas, The Department of City Development recommends release of the deed restriction to facilitate this development subject to approval of final site and building plans by the Department of City Development; and

Whereas, The cost for this process is $1,250, less a 20 percent administrative fee paid to the Redevelopment Authority of the City of Milwaukee; now, therefore, be it
