Individuals in objection:
Daniel Zelonky – 1031 W National Av. – said that his business is a record studio next door and that it has been there for 16 years. He added that his studio is booked around the clock and that he had to send clients home because they were unable to record that day. He continued saying that he also lives above the studio and that he could not slept because the music went until early in the morning. He also has problems with the garbage that is left at his front steps from this business’ patrons.
Ald. Perez said that Mr. Zelonky was the one who made the office aware of this situation.
Ald. Burgelis asked if besides that one event’s noise, the applicant is a good neighbor taking care of the trash.
The witness said that he has not seen an employee picking up the garbage.
Ald. Perez asked the applicant to comply with the plan of operation on file and to continue serving as a community restaurant because it was the way it was granted in order to fit with the location and recommended denial of the Instrumental Musicians, Jukebox and Bands.
Ald. Westmoreland suggested to do the clean ups every hour.
Ald. Perez said that twice/day is fine around 3pm and by closing time.
The applicant agreed to do it twice/day.
Ald. Westmoreland moved to amend the plan of operation to 2 daily cleanups at 3pm and before closing time.

Ald. Zamarripa said that neighbors and a local nonprofit community organization have opposed to this application but given that this is an existing license and not a new location, she wants to make sure that this longtime bar holds the same type of licenses as before.
Ms. Lopez said that they are the same type.
Ald. Zamarripa said that she is looking to make a compromise between the parties and that some changes have been discussed.
Neighbors in objection:
Christian – 3132 W Greenfield Av – said that his main concern happened back in August when there was a party with teenagers drinking heavily and that his property was filled with teenagers as well. He added that teenagers were coming out from the bar with tequila bottles in hand, that he even got to see a girl leaving the bar been touched aggressively outside the premises by another kid. He mentioned that he has a video. He also mentioned that he contacted Esmeralda and that she said that it was a private event but the parties kept on happening for three weeks.
Michael O’Loughlin – Marketing Communications Director of School Sisters of St. Francis – said that he is here representing the school and that the sisters are definitely in opposition.
Ald. Zamarripa thanked the neighbors and the School Sisters representative; she acknowledged that the sisters live around the area and asked the applicant if she is willing to make changes.
The applicant said that she would like to keep the Jukebox only.
Ald. Zamarripa moved to amend the application by removing the Disc Jockey, DJ Equipment, Karaoke and Patrons Dancing and Adding Jukebox. There were no objections.
Ald. Zamarripa said that she is concerned about the neighbor’s testimony.
The applicant said that the first incident was a family event and that parents were there; that the second event was not authorized to happen. She explained that her husband’s son took the keys and held a party while they were in Chicago.
Ald. Burgelis asked who lives upstairs.
The applicant said that her daughter.
Ald. Burgelis asked what assurance she will give to the committee that this would not happen again.

The applicant said that the houses were built in 1930’s as individual homes and that they have been rooming houses since the 80’s for people working in manufacturing jobs in the city among for example, and that it is easier and affordable living arrangement. He also explained that there used to be 5 houses total but one got the license denied.
Ald. Bauman said that one house is a food service house for the tenants (933 N 24th St).
Ald. Zamarripa asked the applicant if he has been in contact with the neighbors.
The applicant said that he has not been in contact with the neighbors following his attorney's advice.
Individuals in opposition:
Charles Smith - 911 N 24th St – said that he attended the meeting 2-3 years ago, when Mr. Conklin applied for the licenses. He said that these licenses were issued illegally, that they have been put up with many bad behaviors, and that these licenses were never before the Common Council.
Mr. Cooney said that Rooming Houses are approved administratively and do not come before committee unless there is an objection or police report attached like it is today. He continued saying that back on 2020, the License Division received 5 new applications, received objections for one of the addresses (the one that was denied) and that the other four did not have objections attached and that is the reason why they were approved.
James Dieter - 2432 W Kilbourn Av – said that he is here year after year and that he has presented a ton of cat calls from MPD and photographs about the building violations. He said that he thinks that the City and MPD have turned their backs on them and that something very smelly happens here because the business still gets its licenses. He added that no one care about them and the problem they have with these houses around.
Ald. Westmoreland asked Atty. Gresham if we are here for the deep dive from 5 years ago or to look at what happened the last year.
Atty. Gresham said that we are here for the last year to shape the year going forward.
Laura Sue Mosier - 3209 W Wells – Schuster Mansion – said that the City came to them asking to do so many things in order to get their business license; even a small window on the second floor that no one can see. She added that she does not understand how these houses can get away with so much going on.

Ald. Bauman said that we should explore why Mr. Dieter presented hundreds of cat calls and there is no PA 33 on file and what kind of complaints DNS received and has checked as well.
Atty. Gresham said that PA 33 are reports that must be considered by the committee and not cat calls.
Lt. Pelnar said that none of the calls had an incident report filed because they are not related to the business operation. He added that the calls are for mental issues and/or parole checks and those do not require a police report.
Jumanee Cheatham (Building Codes Enforcement Manager – DNS) explained that Rooming Houses new applications, renewals and complaints are inspected and they get a fire inspection annually. He added that DNS updates the application if there are issues with the building. He also explained that they went out today to verify the standing orders and that most of them have been satisfied. He said that there are still pending orders on each property but that they all received extensions until October 30th so they are non-delinquent right now.
Ald. Bauman asked what happens if they do not comply.
Mr. Cheatham said that open orders take the normal course of action: re-inspection fees and citations if the orders are not completed.
Ald. Bauman asked if eviction is one course of action.
Mr. Cheatham said that no eviction is enforced by DNS.
Ald. Bauman said that he understands the neighbors but that the filed objections are not related to the rooming houses licenses and that there is no evidence directly related to operations as well.

Vince Toney – 2721 W Roosevelt Dr – said that the committee does not know if the information presented on the application is true and that they know who is the real owner of the LLC because it is not the applicant. He added that they are tired of everything that they have been put up with as neighbors and that the City does not do a thing to protect them. He also said that it could be that they are linked to the current owner based on the information provided on the application.
Ms. Lopez verified that the current owner (Mr. Jabbar) is not listed in the current application.
Shawn Moore – former 4343 N 24th Pl - said that he is a dedicated community member and someone who is being working to reduce violence in the neighborhoods. He added that he is the person who sent somebody in Jabbar’s store to by weed for food stamps. He also said that he was the one who sent the video that the committee watched last year. He explained that the problem is not with the new applicant but with the location that has been involved with illegal activity and the problems that has brought for almost 30 years. He said that he is impressed on how quickly the management changed. He explained that he is concerned about the 20 guns that were recovered and the $3.5 million fraud in food stamps that it is being investigated because he thinks that the practices will continue. He also said that his life was threaten by the previous owner and that he had to leave the city. He also said that he is in conflict with the licenses associated with the store that bring conflict to the area. He asked that no liquor store be granted now because the community needs to heal first.

Mrs. And Pastor Freeman – 3408 N 56th St – said that she has lived there plus 50 years, that her church is there, that she knows Mr. Moore and that he was party of the drug issue at the store. She added that Ms. Nash will be an asset to the neighborhood, that she has been working with her and that the store is needed for the old people like her and others. She added that she started the Garden Homes Association and that her son is the president now.
Desilynn Smith – 4201 N 27th St - United Garden Homes Inc - said that they are in support of the application and that she has been working with Ms. Nash since she heard that she purchased the business. She added that the applicant has allowed her to come to store to talk to people in need and that she thinks is the right thing to do given the nature of the problem in the area.

Ald. Spiker asked the applicant what is her relation with the building owner.
The applicant said that she knew him after the business relationship and that she does not know him personally.
Ald. Spiker asked the applicant if there is another stockholder.
The applicant said that she was just the agent when they filed the application but that she now has 20% ownership.
Ald. Zamarripa asked the applicant if she has purchased the business yet.
Atty. Maistelman said that it is contingent to getting the license.
Ms. Lopez indicated that an amendment is needed to reflect the 20% ownership per Ms. Nash’s testimony.
Ald. Pratt moved to amend the ownership to 80% Ms. Hanan and 20% Ms. Nash.
Ald. Zamarripa asked the applicant about her experience.
The applicant said that most of her experience has been at Model Market for 5 years in Kenosha (where she met her business partner), that her father and mother have lived in the neighborhood forever and that she grew up in the community.
Ald. Jackson asked the applicant how she is going to avoid people from congregating outside.
Atty. Maistelman said that they will increase the lighting; the surveillance cameras will be hooked up with MPD, enlarging the windows, monitoring outside, and posting signs.
Ald. Zamarripa acknowledged that she understands the neighbors’ frustration given the disciplinary actions granted to the current owner who is also the building owner.
Atty. Maistelman said that the building owner is desperate to leave.
Ald. Pratt said that she has met with the applicant, that she joined one of her walks in the neighborhood, that the community is in support of the application but that she wants to see the applicant's commitment to the neighborhood first. She added that neighbors need healthy and fresh food options and peace as well.
Ald. Pratt moved approval of the food and weight & measures licenses and to hold the Class A Malt & Liquor to give the applicant some time to adjust and to show results. There were no objections. (Prevailed 5-0)
