This substitute resolution appropriates $7,500.00 from the Outside Counsel/Expert Witness Fund Special Purpose Account for the purpose of retaining outside counsel to represent the interests of the Fire & Police Commission in the matter of Anderer v. City of Milwaukee Fire & Police Commission, Case No. 02-CV-007711.

Whereas, Police Chief Arthur Jones discharged Police Officer Joseph R. Anderer from the Milwaukee Police Department; and

Whereas, Officer Anderer appealed his discharge to the Board of Fire and Police Commissioners; and

Whereas, The City Attorney's Office has undertaken representation of Chief Jones's interests before the Board in this appeal, that is, the City Attorney's Office is prosecuting Anderer before the Board; and

Whereas, Officer Anderer has filed a lawsuit against the Board to reverse a ruling the Board made regarding the admission of certain evidence; and

Whereas, The City Attorney's Office cannot represent the Board in this lawsuit because it already has undertaken representation of the Chief's interests; and

Whereas, It would be a conflict of interest for the City Attorney's Office to represent the Board and the Chief in the same proceeding; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the proper city officers be and hereby are authorized and directed to appropriate $7,500.00 for the purpose of retaining outside legal counsel to represent the interests of the Board of Fire and Police Commissioners in the above-referenced lawsuit, said amount to be charged to the Outside Cou...
