Analysis
This resolution authorizes payment to Janet Wilhelms in the amount of $22,500.00 related to the claim for damage to personal property in Milwaukee County Circuit Court Case No. 25-CV-0054.
Body
Whereas, the claimant, Janet Wilhelms, has filed a claim against the City of Milwaukee, by and through her attorney, arising from personal injuries related to a trip and fall on a hole created by a missing City of Milwaukee fire hydrant.

Whereas, counsel for the parties have reached an agreement to settle the above-referenced lawsuit for a total amount of $22,500.00, inclusive of all fees and costs, subject to approval by the Common Council; and

Whereas, the City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to pay this claim; now, therefore, be it

Resolved, by the Common Council of the City of Milwaukee that proper City officers be and hereby are authorized and directed to issue a City check in the amount of $22,500.00, payable to Smith & Rowen, S.C. Client Trust Account, 15460 West Capitol Drive, Suite 100, Brookfield, WI 53005 as soon as practicable; and so be it

Further Resolved, that in compliance with the City Attorney’s direction, the proper City officers be and hereby are authorized and directed to issue a check, as soon as practicable, in full and final settlement of all claims arising from damage to personal property; to be charged as follows: to the Water Department Account Account-636506 - Fund No. 0411 - Organization 6410 - Program 2631 - Sub Class R643, and so be it
Further Resolved, that for and in consideration of the above-referenced payments, the claimant, by their representative(s) and/or attorney(s), will provide the city a release of any and all claims arising out of or in any way related to this incident.
