Title
Resolution authorizing the Wisconsin Department of Transportation to access and utilize a portion of four City-owned properties for the National Avenue (STH 59) Pavement Replacement Project, in the 8th and 12th Aldermanic Districts.
Analysis
This resolution permits the City of Milwaukee to authorize use of city-owned parcels as necessary for a highway rehabilitation project.
Body
Whereas, The Wisconsin Department of Transportation (WisDOT) is undertaking a highway improvement project to improve National Avenue (STH 59) between 39th Street and 1st Street and needs to acquire permission for itself and its contractors to access and utilize city-owned property at four (4) locations; and
Whereas, Lands needed for the improvements are owned by the City of Milwaukee; and
Whereas, the portions of City-owned parcels totaling 0.107 acres of the various parcels is necessary for replacing sidewalk and driveways; and
Whereas, WisDOT’s Standard Specifications for Highway and Structure Construction (2025 Edition) (“WisDOT Standard Specifications”) includes provisions regarding protecting and restoring property (Sec. 107.11) and responsibility for damage and tort claims (Sec. 107.12) that are necessary to protect the City’s interests with regard to damage to city-owned property and any tort liability resulting from WisDOT’s contractor’s use of city-owned parcels pursuant to this resolution; now therefore be it
Resolved, By the Common Council of the City of Milwaukee that permission is hereby granted to the Wisconsin Department of Transportation and its contractors to access and utilize city-owned property as described in this resolution for purposes of the National Avenue (STH 59) Pavement Replacement Project, and to take such further acts as are or may be necessary to effectuate this resolution; and, be it
