This resolution accepts Sewer Easement SE-2709 located in the vacated east west alley in the block bounded by West Historic Mitchell Street, West Lapham Boulevard, South 9th Street and South 10th Street.
Body
Whereas, The easterly portion of the east/west alley in the block bounded by West Historic Mitchell Street, West Lapham Boulevard, South 9th Street and South 10th Street was vacated per Common Council Resolution Number 970546 which was adopted on 7/24/1998; and

Whereas, The remaining portion of the public alleys in the block bounded by West Historic Mitchell Street, West Lapham Boulevard, South 9th Street and South 10th Street drain into a catch basin at the easterly end of the vacated alley and is connected to a storm sewer in South 9th Street; and

Whereas, The existing catch basin will remain the property of the City of Milwaukee; and

Whereas, The easement for said surface drainage and catch basin is in the property owned by Mitchell Investment Properties II, a Wisconsin limited partnership; and

Whereas, Sewer Easement SE-2709, granting permission to the City to maintain surface drainage, the catch basin and the drain in said alley has been granted by Investment Properties II and approved as to contents, form, and execution by the proper City officers; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the City of Milwaukee hereby accepts Sewer Easement SE-2709, said sewer easement document being attached to this Common Council Resolution File Number 011228 and incorporated in this resolution by reference as though set forth in full; and, be it
