Resolution relating to Common Council File Number 031640, a resolution authorizing the City of Milwaukee's participation in the 2004 Nike Reuse-A-Shoe Program and application for, and acceptance and expenditure of related grant monies for the purchase of playground surface materials.
Analysis
Common Council File 031640 authorized the City of Milwaukee's participation in the 2004 Nike Reuse-A-Shoe Program and authorized and directed the Department of Public Works-Operations Division to apply for a $20,000 grant from Nike, Inc. to be used for the purchase of a new City of Milwaukee playground/tot lot surface made from recycled shoe materials. This resolution approves an indemnification agreement between Nike, Inc., the National Recycling Coalition, Inc., and the City of Milwaukee under which the City holds harmless and indemnifies the other two parties from any and all claims, demands, losses, damages, expenses and liabilities relating to the construction, maintenance, location, condition or use of the grant-funded playground surface materials.

Whereas, Common Council File Number 031640, adopted April 13, 2004, authorizes the Department of Public Works-Operations Division (Sanitation Section) to apply for, accept and expend a Nike Reuse-A-Shoe grant from Nike, Inc., for the purchase of a City of Milwaukee playground/tot lot surface made from Nike Grind, a material produced from recycled shoes; and

Whereas, The Department of Public Works-Operations Division (Sanitation Section) seeks further authorization to enter into an indemnification agreement with Nike, Inc., and the National Recycling Coalition, under which the City holds harmless and indemnifies the other two parties from any and all claims, demands, losses, damages, expenses and liabilities relating to the construction, maintenance, location, condition or use of the grant-funded playground surface mater...
