Title
Substitute resolution authorizing the transfer of funds from the MPD Federal Forfeiture Revenue Contribution Account to the Police Department’s budget.

Analysis
This resolution approves the transfer of $1,171,704 to the Milwaukee Police Department’s budget to fund items in accordance with guidelines of the Asset Forfeiture Equitable Sharing Program. Items to be purchased with these funds include:

Body
Whereas, The Asset Forfeiture Equitable Sharing Program operates through the U.S. Department of Justice; and

Whereas, The Milwaukee Police Department receives Equitably Shared Funds from proceeds of assets seized under the program; and

Whereas, The Milwaukee Police Department is bond to comply with program regulations as contained in the “Guide to Equitable Sharing for State, Local and Tribal Law Enforcement Agencies”, revised in March of 2024; and

Whereas, these guidelines state that “Agencies may use equitably shared funds only for law enforcement purposes that directly supplement the agency’s appropriated resources; and

Whereas, these guidelines further state that “…law enforcement agencies will not receive equitable sharing if the governing body or state, local, or tribal law, regulation, or policy requires or directs (1) specific expenditures of shared funds …; and


Whereas, the Milwaukee Police Department currently has funds held in trust (Fund 0678) to increase or enhance law enforcement efforts in the City of Milwaukee; now therefore be it

Resolved, By the Common Council of the City of Milwaukee, that the City Comptroller is authorized to transfer up to $1,171,704 from the Milwaukee Police Department’s Federal Forfeiture Trust Fund...
