Title
Resolution authorizing the waiver of s. 106-2.1 of the Milwaukee Code, a prohibition of drinking upon public parking structures and public parking surface lots, for Miller Park parking surface lots.
Analysis
Unless granted a waiver by common council resolution, it is unlawful to consume any alcohol beverage or possess any alcohol receptacle whose seal was broken, or its contents partially removed while upon any public parking structure or public parking surface lot within the limits of the city as regulated in s. 106-2.1 of the Code. This resolution authorizes a waiver to s. 106-2.1 when Miller Park is used for sporting events and concerts.
Body
Whereas, Section 106-2.1 of the Code prohibits persons from consuming or opening the seal on any alcoholic beverage while upon any public parking structure or public parking surface lot within the limits of the city; and
 
Whereas, The 2005 baseball season is scheduled to begin in April 2005; and
 
Whereas, Several concerts are also held at Miller Park; and
 
Whereas, Tailgate parties are frequently hosted on public surface parking lots at Miller Park when Miller Park is used for sporting events and concerts; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that a waiver to 106-2.1 of the Code is granted for the remainder of calendar year 2005 during those dates and times when Miller Park is used for sporting events or concerts.
