- ANALYSIS -

As described by Section 32.52 through 32.57 of the Wisconsin Statutes (1995-1996), the Board of Assessment has completed their review and determination of assessment of benefits and the award of damages due to securing easements over riparian rights along the west side of the Milwaukee River between West Wells Street and West Kilbourn Avenue.


BODY:
Whereas, Pursuant to Common Council File Number 971690 adopted on March 3, 1998, the Board of Assessment has determined the amount of benefits to be assessed and the damages to be paid against 4 properties located along the west side of the Milwaukee River between West Wells Street and West Kilbourn Avenue; and

Whereas, The Board certifies that it has complied with requirements of sections 32.52 through 32.57, Wisconsin Statutes, as they pertain to exercising eminent domain; and

Whereas, Three preliminary hearings were held on March 10, 11 and 12, 1998 to hear testimony of any interested party regarding the benefits or damages resulting from the proposed riverwalk improvement, and

Whereas, Two review hearings were held on April 21 and 22, 1998 to hear testimony and consider evidence on the amount of benefits and damages assessed; and

Whereas, Based upon testimony provided at these hearings and information provided by City staff, the Board has made a final determination of the benefit of assessments and amount of damages and is attached as Exhibit "A".
