This resolution removes the deed restriction on three former City-owned vacant lots.
BODY:
Whereas, The City of Milwaukee conveyed to Emmaus Evangelical Lutheran Church three vacant lots located at 2801-03 and 2811 North 22nd Street via two Quit Claim Deeds dated December 18, 1979 and April 30, 1987, pursuant to Common Council File Nos. 79-928 and 86-2005, adopted on November 13, 1979 and April 7, 1987; and
Whereas, Said deeds of conveyance contained a restriction that the land conveyed therein, "shall be used as open space and no principal building may be erected thereon without the approval of the Common Council of the City of Milwaukee"; and
Whereas, Emmaus Evangelical Lutheran Church is planning to build a Child Care Center on said vacant lots; and
Whereas, Removal of the deed restriction will allow said Church to build a Child Care Center on this portion of said vacant lots; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the proper City officials are authorized and directed to execute the necessary legal documents to remove the restriction contained said Quit Claim Deeds, dated December 18, 1979 and April 30, 1987, to allow for the building of said structure.
