This ordinance establishes a pedestrian mall in South 29th Street, from West Orchard Street to a point approximately 180 feet south of West Orchard Street, in the 8th Aldermanic District for public use and private use by Nativity Jesuit Academy. Providing testimony in support: Machez Martinez, NJA teacher and parent Mark Heron, NJA board member There was discussion regarding public and private use of the pedestrian mall, community outreach, safety, green space availability, accessibility, and signage/messaging. Commissioner Gonzalez moved approval, seconded by commissioner Crane. (Prevailed 7-0)

Analysis
This ordinance establishes a pedestrian mall to be known as “Nativity Jesuit Pedestrian Mall” in South 29th Street, from West Orchard Street to a point approximately 180 feet south of West Orchard Street, in the 8th Aldermanic District. The ordinance is consistent with s.66.0905 and 62.71, Wis. Stats.

Whereas, The City of Milwaukee desires to establish a pedestrian mall to be known as “Nativity Jesuit Pedestrian Mall” in South 29th Street, from West Orchard Street to a point approximately 180 feet south of West Orchard Street, in the 8th Aldermanic District; and

Whereas, In accordance with s. 62.71(4), Wis. Stats., the Common Council finds that:

a. The proposed pedestrian mall will be located adjacent to a business district as it is in the vicinity of storefronts at the intersection of West Greenfield Avenue and South Layton Boulevard, as well as nearby schools and hospital.

b. Reasonably convenient alternate routes exist for private vehicles to traverse around the proposed pedestrian mall.

c. Continued, unlimited use by private vehicles of the proposed pedestrian mall would endanger pedestrian safety.

d. Properties abutting the proposed pedestrian mall can be provided reasonably and adequately with emergency vehicle services, as well as delivery and receiving of merchandise or materials, from other streets or alleys.

e. It is in the public interest to use the proposed pedestrian mall for pedestrian purposes.

f. Preparation of preliminary plans, acquisition of land, and use of public funds are unnecessary to improve the proposed pedestrian mall, considering that all plans and improvements will be co...
