The current city animal control provisions require the commissioner of health to destroy any animals that appear to be rabid. This ordinance authorizes, but does not require, the commissioner to destroy such animals in accordance with the relevant requirements of state statute. In accordance with state statute, the ordinance also authorizes, but does not require, the commissioner to destroy animals other than dogs or cats that have bitten a person.
BODY:
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
 
Part 1. Section 78-27-2 of the code is repealed and recreated to read:
 
78-27. Control of Rabid Animals.
 
2. a. If, upon investigation by the commissioner an animal other than a dog or cat has bitten a person or appears to be infected with rabies, the animal may be destroyed as directed by the commissioner of health, in accordance with s. 95.21(4)(b), Wis. Stats.
 
b. If, upon investigation by the commissioner and a determination by a veterinarian that a dog or cat exhibits symptoms of rabies, the dog or cat may be destroyed as directed by the commissioner of health, who shall act in accordance with s. 95.21(5)(d), Wis. Stats.
