Body
Whereas, Champion Environmental ("Champion") was awarded a contract with the City of Milwaukee ("City") to provide demolition services for the Century City Project in 2010; and
Whereas, Damage involving the steel truss system on Building 38 and the roof of Building 36 occurred during demolition activities; and
Whereas, Champion filed two claims with its insurance company, Endurance American Specialty Insurance Company ("Endurance"), for a total of $198,687 to cover the damages; and
Whereas, The City and Endurance developed a Release of All Claims document, a copy of which is attached to this Common Council File, and agreed to a settlement that covered 75 percent of the original two claims, or $149,015.25, to resolve the matter; and
Whereas, The City Attorney, the Redevelopment Authority of the City of Milwaukee and the Department of Neighborhood Services recommend acceptance of this release and settlement; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the appropriate City officials are directed to sign the Release of All Claims for Building 38 truss damage and Building 36 roof damage and accept the settlement amount of $149,015.25; and, be it
Further Resolved, That the settlement amount be returned to the Century City Redevelopment Corporation Operating Account to be used for on-going project costs.
