Title
Resolution removing deed restrictions from three former tax-deed vacant lots located in a new development project area, in the 6th Aldermanic District.
Analysis
This resolution removes deed restrictions on three former tax-deed vacant lots imposed by the City of Milwaukee that prohibits division of property and construction of any principal buildings thereon.
Body
Whereas, Pursuant to Common Council approval, the City of Milwaukee conveys non-surplus-size vacant lots to adjoining owners by Quit Claim Deed; and
 
Whereas, The deeds of such conveyances contain restrictions that the land conveyed therein "shall be used as open space and no principal buildings may be erected thereon, to join the lot with the buyer's adjoining property so as to create a single parcel to be used as a unit, and that the combined parcel shall not be divided without the approval of the Common Council of the City of Milwaukee"; and
 
Whereas, The development site for a Women's Pre-Release Center, the sale of tax-deed land that has already been approved by the Common Council, contains three parcels with the above deed restrictions and removal of the restrictions is required for the project to proceed as planned; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the proper City officials are authorized and directed to execute the necessary legal documents to remove the restrictions contained in the three deeds affecting said project site to allow for development of the property.
