Analysis
This resolution authorizes the proper City officials to execute Permanent Limited Easement and Donation Waiver of Appraisal documents with the Wisconsin Department of Transportation for their rights to have and maintain an overhead sign adjacent to the Ellen Street Playlot located at 1829 East Fernwood Avenue. The sign is mounted along the Lake Parkway but a small portion of the overhead sign encroaches a couple of feet beyond the Lake Parkway's right-of-way line. There is about 18 feet between the ground and the bottom of the sign.
Body
Whereas, The Wisconsin Department of Transportation completed the construction of the Lake Parkway (STH 794) between the Hoan Bridge and West Layton Avenue in 1999; and

Whereas, As part of the Lake Parkway’s traffic operations an overhead sign was constructed on Lake Parkway right-of-way which encroaches beyond the Lake Parkway's right-of-way onto the City-owned Ellen Street Playlot for a distance of +/- 2 feet and there is about 18 feet between the ground and the bottom of the sign; and

Whereas, The sign is a necessary part of the traffic operations of the Lake Parkway; and

Whereas, The Wisconsin Department of Transportation has submitted the necessary documents that will grant them the rights to encroach and maintain the subject sign over a small portion of the Ellen Street Playlot located at 1829 East Fernwood Avenue; and
