Body

WHEREAS, the Housing Authority of the City of Milwaukee (HACM) was created by City of Milwaukee Common Council Resolution 78409 (April 28, 1944) declaring the need for the authority pursuant to Wis. Stat. § 66.44 (now renumbered as § 66.1201); and

WHEREAS, based the City of Milwaukee’s declaration, HACM exists as a public body corporate and politic, which may transact business and exercise any powers granted to it by Wis. Stat § 66.1201.  See Wis. Stat. §§ 66.1201(4)(a), (c); and

WHEREAS, in its exercise of public powers, HACM has all the powers necessary or convenient to carry out and effectuate the purposes and provisions of its governing statutes including, without limitation, to sue and be sued, and to make and execute contracts and other instruments necessary or convenient to the exercise of the powers of the authority; and

WHEREAS, HACM wishes to facilitate prompt, efficient, fair, and equitable evaluation and disposition of claims against it; now therefore

BE IT RESOLVED, that the Secretary-Executive Director, after working with staff to assess available insurance coverage and in consultation with legal counsel, is authorized to investigate and make settlement of claims and litigation not in excess of $10,000, using exclusively non-federal funds; and

BE IT FURTHER RESOLVED, that the Secretary-Executive Director is directed to develop recommendations to the Board of Commissioners regarding any further memorialization of this authority and any creation or amendment of procedures for its implementation.
