Analysis
This resolution grants MRED (Lincoln/Forest Home) Associates, a Wisconsin Limited Partnership permission to design, construct and maintain the newly dedicated east/west public alley right-of-way bounded by South Muskego Avenue, West Forest Home Avenue, West Lincoln Avenue, South 25th Street, and West Grant Street.
Body
Whereas, The alley bounded by South Muskego Avenue, West Forest Home Avenue, West Lincoln Avenue, South 25th Street, and West Grant Street, is presently unimproved public right-of-way; and

Whereas, MRED (Lincoln/Forest Home) Associates, a Wisconsin Limited Partnership owns the property located at 2410 West Forest Home Avenue; and

Whereas, Permission for private entities to improve public right-of-way for access can be granted in a Special Permission Agreement; and

Whereas, A Special Permission Agreement has been prepared, which specifies MRED (Lincoln/Forest Home) Associates, a Wisconsin Limited Partnership shall bear all design, construction and maintenance costs associated with such access; and

Whereas, The Special Permission Agreement also specifies that the alley shall remain open for the general public's use at all times; and

Whereas, Permission to allow MRED (Lincoln/Forest Home) Associates, a Wisconsin Limited Partnership, to design, construct and maintain the newly dedicated east/west public alley right-of-way can only be approved by the Common Council; now, therefore, be it
