This resolution appropriates $5000 from the Outside Counsel/Expert Witness Fund to the City Attorney's Office to retain an expert witness in case No. 2023CV5474 Robert Kohlhoff et al v. City of Milwaukee, et al.
Body:
Whereas, The Outside Counsel - Expert Witness Fund is to be used by the City Attorney's Office to retain the services of expert witnesses and outside legal counsel; and
Whereas, any appropriation of funds from this Fund requires approval by the Common Council via resolution; and
Whereas, The City Attorney’s Office needs to retain an expert witness in Milwaukee County Circuit Court Case No. 2023CV5474 Robert Kohlhoff et al v. City of Milwaukee, et al, as Mr. Kohlhoff has brought forth a lawsuit against the City of Milwaukee based on a January 4, 2021 auto accident with a Department of Public Works city of Milwaukee employee; alleging the city of Milwaukee employee was negligent and was the direct cause of injuries the Plaintiff sustained;
Whereas, The City Attorney has determined that it would be in the best interests of the City to obtain an expert witness; and
Whereas, the office of the City Attorney desires to hire Dr. Thomas O’Brien MD as an expert witness to defend the City defendants in the above referenced lawsuit; now, therefore be it
Resolved, By the Common Council of the City of Milwaukee, that the City Attorney is authorized to hire Dr. Thomas O’Brien MD as an expert witness in Milwaukee County Circuit Court Case No. 2023CV5474 Robert Kohlhoff et al v. City of Milwaukee, et al; and be it
