Title
Resolution authorizing and directing the proper City officers to execute a Deed Restriction and accept a Cap Maintenance Plan for the City of Milwaukee owned property located at 2931 W. Cameron Ave. (Water Works)
Analysis
This resolution authorizes and directs the proper City officers to execute a Deed Restriction and accept a Cap Maintenance Plan addressing the presence of contaminated soils at the Milwaukee Water Works Cameron Yard.
Body
Whereas, Soils contaminated with petroleum volatile organic compound (PVOC) and polynuclear aromatic hydrocarbon (PAH) have been identified on the City of Milwaukee owned property located at 2931 W. Cameron Ave., which is a portion of the Milwaukee Water Works Cameron Yard, due to the former tar wells located on this property; and

Whereas, It is the City of Milwaukee's desire and intention to impose restrictions on this property which will make it unnecessary to conduct further soil remediation activities at the present time; and

Whereas, This Deed Restriction and Cap Maintenance plan has been approved by the Wisconsin Department of Natural Resources (WDNR) and said documents will enable the City of Milwaukee to obtain final site closure from the WDNR; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City Officers are hereby authorized and directed to execute the document for the Deed Restriction and accept the Cap Maintenance Plan, copies of which are attached to and part of this file; and, be it

Further Resolved, That after said Deed Restriction has been executed by the proper City Officers, it shall be forwarded to the Department of Public Works for recording and proper distribution.
