- Analysis - This resolution authorizes cancellation of the Department of Public Works Invoice No. 64137 billed to Karp's Truck Corporation in the amount of $2,381.50 for damage to two trees. _______________________________________________________
BODY:
Whereas, On June 15, 1995, a Karp's Truck Corporation semi-truck, No. 2851 operated by Wade Holdridge collided with overhanging branches of two (2) trees located at 3025 East Hampshire Street causing $2,381.50 worth of damages to said City property; and
Whereas, Mr. Holdridge was proceeding along an approved "truck route", when the vehicle was forced by barrels and traffic signs to deviate from said route. The truck encountered low clearance in the form of said trees shortly after entering the detour; and
Whereas, The Kohn Law Firm, the City of Milwaukee's collection law firm, and the Office of the City Attorney believe Karp's Truck Corporation can not be held liable for these damages because the semi-truck was directed to take this route and the cancellation of the invoice is be a fair and equitable resolution and is in the best interests of the City; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee the Department of Public Works' Invoice No. 64137 in the amount of $2,381.50 billed to Karp's Truck Corporation be and the same is hereby cancelled.
