Resolution approving amendment to lease agreement with Lake Express, LLC. (Port of Milwaukee)
Analysis
This resolution would approve Amendment to Lease Agreement with
Lake Express, LLC (Tenant) for five (5) acres of property on the Port's South
Harbor Tract.
BODY
Whereas, Lake Express, LLC is in good standing with the Port of Milwaukee and has an existing lease dated April 28, 2003; and
Whereas, City leased to Tenant certain land and further agreed to construct on such land certain improvements to be mutually agreed upon by City and Tenant; and
Whereas, City and Tenant desire to enter into this First Amendment for the purpose of (i) confirming the commencement and termination dates of the Lease; (ii) confirming the description of the property and the improvements in the Lease to the final site plan and as-built construction drawings for the property and the improvements; and (iii) confirming the rent to be charged for their Premises; and
Whereas, The Board of Harbor Commissioners at their meeting of November 11, 2004 acted by vote of the Board to grant such Amendment; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that said Common Council hereby ratifies and approves the Amendment to Lease Agreement between Lake Express, LLC and the City of Milwaukee, by and through its Board of Harbor Commissioners for the period of July 1, 2004 through December 31, 2014; and, be it
Further Resolved, That the designated officers of said government and of said Board of Harbor Commissioners are hereby authorized and directed to execute an agreement to carry out this purpose, as prepared by the City Attorney's office.
