This resolution authorizes a settlement payment in the amount of $20,000 as to any and all claims arising from the facts and circumstances alleged in U.S. District Court E.D. Wis. Case Number 23-CV-0413 and/or U.S. Ct. App. for the 7th Circuit Case Number 25-1135.

Whereas, Plaintiff Nakia Hollis filed the above-referenced civil lawsuit in U.S. District Court of the Eastern District of Wisconsin, individually and as special administrator of the Estate of Dijon Marks-Hollis and on behalf of Marks-Hollis’s minor children, alleging that the City and city employees are liable to the plaintiffs for civil rights violations arising from an incident that occurred on November 7, 2019, while Marks-Hollis was in custody at District Seven;

Whereas, counsel for the parties have reached an agreement to settle the above-referenced lawsuit for a total amount of $20,000.00, inclusive of all fees and costs, subject to approval by the Common Council; and

Whereas, the City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to settle this lawsuit; now, therefore, be it

Resolved, by the Common Council of the City of Milwaukee, that the proper City officers be and hereby are authorized and directed to issue a City check in the amount of $20,000.00, payable to: Walter Stern Trust Account, as soon as practicable; and so be it

Further Resolved, that in compliance with the City Attorney’s direction, the proper City officers be and hereby are authorized and directed to issue a check, as soon as practicable, in full and final settlement of all claims as outlined in the above-referenced action, to be char...
