This ordinance prohibits the sale of animals to persons convicted of animal abuse under ch. 951, Wis. Stats., within the past 5 years.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. Section 78-4 of the code is created to read:

78-4. Prohibition of Transfer of Animals to Animal Abusers. 1. BACKGROUND VERIFICATION. Prior to the exchange or transfer of ownership of any animal in the care of a pet shop licensed under s. 78-9 operating in the city of Milwaukee, an employee or volunteer of the entity shall consult the Wisconsin Circuit Court Consolidated Court Automation Programs (CCAP) to determine whether the person seeking ownership of such animal has been convicted under ch. 951, Wis. Stats., within the past 5 years.

2. PROHIBITION. No entity required to consult the Wisconsin Circuit Court Consolidated Court Automation Programs (CCAP) shall exchange or transfer the ownership of any animal to a person convicted under ch. 951, Wis. Stats., within the past 5 years.

Part 2. Section 78-9-4 of the code is amended to read:

78-9. Pet Shops.

4. RECORD OF SALE. Every pet shop shall keep a record of every dog and cat sold by the establishment setting forth the date and source of acquisition, date of rabies vaccination, the date of sale >>,<< [[and]] the name and address of the purchaser >>, and proof of purchaser’s background verification under s. 78-4<<. Such records shall be maintained on the pet shop premises for at least one year following the date of sale of each dog and cat, and such records shall be open to inspection by the commissioner at all times during which the pet shop is open to the public.

Part 3. Section 78-55-6-a of the code is amended to read:
