Analysis
This resolution will eliminate from certain property an unnecessary reservation for public alley purposes east of North 35th Street at West Kaul Avenue extended.
Body
Whereas, A 10-foot wide reservation for public alley purposes was created by a Quit Claim Deed dated August 20, 1941, recorded in the Milwaukee County Register of Deeds Office as Document Number 2330677; and
Whereas, The Mason Temple Church of God in Christ, owner of the subject property located at 6090 North 35th Street, as requested the removal of the alley reservation in order to construct a new church; and
Whereas, The City of Milwaukee no longer deems is necessary to retain the reservation for public alley purposes; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee hereby rejects the reservation for public alley purposes, described as follows:
The east 10.00 feet of the following described Land in the Northeast ¼ of Section 25, Township 8 North, Range 21 East: Commencing at a point in the west line of said ¼ Section, said point lying 855 feet north of the southwest corner of said ¼ Section; thence Easterly, parallel to the south line of said ¼ Section, 170 feet to a point; thence Northerly, parallel to said west line, 99 feet to a point; thence Westerly, parallel to said south line, 170 feet to a point in said west line; thence Southerly, along said west line, 99 feet to the point of commencement; and, be it
Further Resolved, that the City Engineer is hereby directed to have a certified copy of this resolution recorded in the office of the Register of Deeds of Milwaukee County.
