Title
Substitute resolution vacating portions of the North-South alley in the block bounded by East Locust Street, North Newhall Street, East Linnwood Avenue and North Cambridge Avenue, declaring the vacated area surplus to municipal needs and authorizing conveyance to the adjoining owner, in the 3rd Aldermanic District.
Analysis
This substitute resolution vacates portions of said alley in accordance with vacation proceedings under power granted to the City of Milwaukee by Section 62.73, Wisconsin Statutes, and Section 308-28, Milwaukee Code of Ordinances, directs disposition of the right-of-way to the adjoining owner after it reverts to City ownership and reserves certain lands for public street purposes.
Body
Whereas, By adoption of File No. 010128 on May 30, 2001, the Common Council of the City of Milwaukee approved the vacation of excess right-of-way on East Locust Street between North Newhall Street and North Cambridge Avenue and the subsequent conveyance of the vacated area to Jeffrey F. Rodman and Gaurie A. Rodman (“Rodmans”) for residential development; and

Whereas, The Rodmans have requested vacation of an additional three feet along both sides of the North-South alley in the block bounded by East Locust Street, North Newhall Street, East Linnwood Avenue and North Cambridge Avenue pursuant to the provisions of Section 62.73, Wisconsin Statutes; and

Whereas, The Department of Public Works has been authorized and directed to prepare a coordinated report estimating all costs and benefit assessments that will be incurred with said vacation; and

Whereas, That as provided by Section 840.11, Wisconsin Statutes, a lis pendens must be filed with the Milwaukee County Register of Deeds; and

Whereas, Said vacation has been reviewed in accordance with Section 308-28, Milwaukee Code of Ordinances; and
