This resolution authorizes settlement of EEOC Charge No. 260990689, Darlene Wagner v. City of Milwaukee Health Department, in the amount of $19,500 which represents attorney fees and costs; $5,560.60 which represents damages; and $65,445 which represents front and back pay, plus City pension contributions, and medical and dental insurance payments.


BODY:
Whereas, The charging party, Darlene Wagner, filed a discrimination charge with the EEOC, claiming discrimination based upon actual or perceived disability for placing her on an involuntary leave of absence on January 22, 1999; and

Whereas, The parties have agreed to settle this lawsuit in the amount of $19,500 which represents attorneys fees and costs; $5,569.60 which represents damages, and $65,445.00 which represents back pay and front pay for the period of April 13, 1999 through November 26, 2000, from which all appropriate payroll deductions will be made including state and federal taxes, plus the payment of City pension contributions and medical and dental insurance premiums as set forth in the proposed Settlement and Mutual Release Agreement attached to this file; and

Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it is expeditious and just to settle this lawsuit; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the City Attorney be and hereby is authorized to execute the Settlement and Mutual Release Agreement; and, be it

Further Resolved, By the Common Council of the City of Milwaukee that the proper City officers be and hereby are authorized and directed to issue a City check in the amount of $19,500, payable to A...
