Analysis
This resolution authorizes the Commissioner of Public Works to sign ten separate public access easements for ten small corner plazas constructed as part of the East Capitol Drive streetscape project. Each of the plazas is located on private property but has been constructed with a combination of City and private funds. The plazas will each be maintained by the underlying private property owner. The easements ensure the right of public access to the plazas.

Whereas, The Riverworks Business Improvement District (BID #25) and the City of Milwaukee have undertaken a streetscape project along East Capitol Drive between North Humboldt Boulevard and North 2nd Street; and

Whereas, One of the key design elements of the streetscape project was the development of ten small plazas at various street intersections within the project area; and

Whereas, Each of these plazas is located on private property; and

Whereas, A combination of private and City of Milwaukee funds was used to pay for the plaza improvements; and

Whereas, The rationale for using public funds for the plazas was that the general public would be able to utilize them; and

Whereas, To ensure the public's right to use the plazas, public access easements were secured from each of the affected property owners; and

Whereas, The easements commit the private property owners to maintain the plazas at their expense with the City having no maintenance responsibilities; now, therefore, be it
