Title

Resolution approving a 1st Amendment to a Lease Agreement with the DeLong Company, Inc.

Analysis

This resolution approves a 1st Amendment to a Lease Agreement with the DeLong Company, Inc. for 4 parcels of real property comprised of 4.64 acres located on Port Milwaukee’s South Harbor Tract.

Body

Whereas, The Common Council ratified and approved a Lease Agreement between the DeLong Company, Inc., and the City of Milwaukee, by and through its Board of Harbor Commissioners, on September 22, 2020; and

 

Whereas, The terms of the lease are 15 years commencing November 1, 2020 and ending on October 31, 2035; and

 

Whereas, The lease can be extended for 3 successive periods of 5 years each, ending at maximum on October 31, 2050; and

 

Whereas, The DeLong Company, Inc.  will be permitted to use Port property for purpose of receiving, handling, storing, packaging, and delivery of dried distillers grains with solubles or other agribusiness products and commodities; and


Whereas, The Board of Harbor Commissioners at its meeting of February 10, 2022 acted by unanimous vote of the Board to grant the 1
st Amendment to the Lease Agreement; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Common Council ratifies and approves the 1st Amendment to the Lease Agreement between the DeLong Company, Inc., and the City of Milwaukee, by and through its Board of Harbor Commissioners; and, be it

 

Further Resolved, That the designated officers of the City and of the Board of Harbor Commissioners are authorized and directed to execute the 1st Amendment to the Lease Agreement to carry out this purpose, as prepared by the City Attorney's Office.
