Analysis

This resolution reverses the December 15, 2003, decision of the Historic Preservation Commission denying a certificate of appropriateness for a request to install a retaining wall, an ornamental fence and plantings at 112 East Brown Street.  This would, in effect, permit such installations to proceed.

Body

Whereas, The owner of the property at 112 East Brown Street has requested a certificate of appropriateness for the purpose of installing a retaining wall, an ornamental fence and plantings at this location; and

Whereas, The Historic Preservation Commission, on December 15, 2003, rejected this request after a public hearing; and

Whereas, The owner of this property, pursuant to s.308-81-9 of the Milwaukee Code, is entitled to appeal this decision of the Historic Preservation Commission to the Common Council, and has filed a request for a hearing of his appeal in a timely manner; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the December 15, 2003, decision of the Historic Preservation Commission denying a certificate of appropriateness for installing a retaining wall, an ornamental fence and plantings at 112 East Brown Street is reversed.
