This resolution directs the Department of Administration -Budget and Policy Division to seek introduction and passage of legislation providing a definition of “center for the visual or performing arts” in the Wisconsin State Statutes for the purpose of preventing the misuse of this classification. Pursuant to s. 125.07(3)(a)3, Wis. Stats., underage persons are permitted to be on the premises of “…centers for the visual or performing arts” at times when alcohol beverages are being served or consumed. The statutes, however, provide no definition of or criteria for this classification.

Whereas, Section 125.07(3)(a)3 of the Wisconsin State Statutes permits underage persons to be on licensed Class “B” alcohol beverage premises at times when alcohol beverages are being served and consumed if these premises are, in the language of the statutes, “…centers for the visual or performing arts”; and
Whereas, The statutes provide no definition of or criteria for determining what constitutes a center for the visual or performing arts; and
Whereas, The City of Milwaukee has a profound interest in preventing the purchase and consumption of alcohol beverages by underage persons; and
Whereas, Recently, concern has arisen that the operators of alcohol beverage establishments might seek to use this classification merely as a way of opening their establishments to underage persons - whether or not these establishments are legitimate centers for the visual or performing arts; now, therefore, be it
