This resolution amends the disposition of said surplus, vacant, tax deed lot by the City of Milwaukee.
BODY:
Whereas, The Common Council of the City of Milwaukee adopted File No. 970274 on June 24, 1997, which declared 3125 West Wells Street surplus and directed that it be split equally and sold to the west adjoining owners; and

Whereas, One of the owners to the west (752 North 32nd Street) has relinquished his right to purchase a portion of said lot; and

Whereas, The adjoining owner to the east (3119 West Wells Street) has expressed an interest in purchasing a portion of said lot; and

Whereas, The Department of City Development recommends sale of the east 7 feet to the easterly owner at 3119 West Wells Street and that the remaining 43 feet by 150 feet be split equally between the two westerly owners at 746 North 32nd Street and 3131 West Wells Street, each portion to be sold for $1; and

Whereas, To provide auto access to the rear of 746 North 32nd Street, a permanent driveway easement will be placed on the portion of said lot to be sold to the owner at 3131 West Wells Street; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that said Offers are accepted and that the proper City officials are authorized and directed to perform such acts as may be required to consummate the sales and that the proceeds be credited to the Reserve For Tax Deficit Fund Account No. 02-211-2700; and, be it

Further Resolved, That the Deed of Conveyance for the portion of said lot to be sold to the owner at 3131 West Wells Street shall contain a permanent 10 foot driveway easement running along the eastern line of said portion, which will run with the land.
